Proposal summary

We want to update OPSS.PROV 100- MTO General Conditions of Contract. With this, there are update requirements due to recent Construction Act Amendments that were approved under Bill 216 and Bill 60. The changes in the NSSP are due to the Construction Act Amendments requiring changes to OPSS.PROV 100 – MTO General Conditions to align with the Act, as amended.

Proposal details

OPSS.PROV 100 – MTO General Conditions of Contract is being updated with the following:

• Revision to definitions

• Revision to Termination of Contract posting notice timeline requirements

• Progress Payment Certificate clarifications

• Substantial Performance revisions

• Annual Statutory Holdback Release revisions

• Revisions to Construction Act references that have been repealed in the Act
