Exception summary

The Buy Ontario Act officially came into effect on December 11, 2025, and the Buy Ontario Procurement Directive, including the Capital Infrastructure component, will take effect for all new capital infrastructure improvements on April 13, 2026.
 

Why consultation isn't required

Due to reduced implementation timelines, this initiative did not provide time to consult via the TCP. Despite this, significant consultation has been undertaken, including engagement with MPBSDP, Metrolinx, Infrastructure Ontario, Heads of Operations Services, the Contracts Documents Committee, the Joint Construction and Engineering Functional Team, Managers of CPDB, the Maintenance Office, MTO Legal, the Standards Management Section, and ORBA.

Exception details

MTO is addressing the Buy Ontario Directive requirements through a Notice to Bidders non standard special provision requiring contractors to submit a Domestic Supply Chain Plan and declaration with their bid and then update their Domestic Supply Chain Plan throughout construction. 

The Directive establishes requirements for ministries, such as MTO, to prioritize Ontario and Canadian‑made goods and services in procurements.
Under the Capital Infrastructure portion of the Directive, MTO will require contractors to submit a Domestic Supply Chain Plan. This plan must identify the source of each listed major good and service and include a declaration confirming that no less than 50% of the total bid value consists of Ontario or Canadian‑made goods and services.
